The Usuals: Service Agreement

Effective Date: The date you complete your first payment.

Parties: This agreement is between The Usuals (“Service Provider”) and you (“Client”).

1. Services Provided
The Usuals will provide marketing services as described in your selected package. This may include:
• Weekly social media content
• Email and SMS campaigns
• Ongoing technical and creative support

2. Payment & Billing
• Services are billed month-to-month at the agreed package rate.
• Payment is due before services for that month begin.
• Work will not be performed until payment is received in full.

3. SMS/Text Message Costs
• Your plan includes up to $25 in SMS/text message sending costs per month.
• If costs exceed $25 in any month, you will be invoiced for the difference before additional messages are sent.
• SMS costs are calculated by our sending platform (Brevo) and may vary depending on message length, volume, and destination.

4. Term & Cancellation
• This agreement is month-to-month and will automatically renew unless canceled.
• You may cancel at any time by providing written notice at least 7 days before your next billing date.
• No refunds are issued for partial months after payment is processed.

5. Content & Approval
• All campaigns and materials will be shared for review before going live.
• You are responsible for reviewing and approving all content. Once approved, changes may be subject to additional fees.

6. Responsibilities
• The Usuals will make reasonable efforts to meet deadlines and deliver quality work.
• The Client agrees to provide necessary access, information, and approvals in a timely manner.

7. Limitation of Liability
• The Usuals is not liable for lost sales, lost leads, or any damages resulting from service use, campaign results, or downtime.
• No guarantees are made regarding specific performance outcomes.

8. Domain Ownership and Transfer
• During the term of this agreement, The Usuals will retain ownership of any domain names purchased or registered on behalf of the Client.
• Upon cancellation or non-renewal of services, the Client may request a transfer of the domain name. The Usuals will provide transfer instructions upon receipt of the request, subject to any applicable transfer fees.
• If the Client misses a payment, The Usuals reserves the right to suspend the domain.
• If payment is not received and the Client does not request to purchase the domain within thirty (30) days of notification, The Usuals may release the domain back into the public market.
• After release, The Usuals has no further responsibility for the domain name, and it may be purchased by any party.

9. Acceptance
By checking the box below, you confirm that you have read, understood, and agree to be bound by this Service Agreement.
